The only thing im confused with is the period between the release of BTW and the Jay Leno show was very short(maybe 5-6 days). If Madonna did make it known that she approved of the song before the incident, then was it really a lie? Other than the format of the approval that was given(an e-mail). I don't see how it would be a lie.

Madonna is not using her voice. Madge does not have to pay for it, but the arena and the promoter that hired Madonna to perform have to pay some coins to the writers but that's it. Nobody needs permission to cover a song on tour.
