So my friend's flipping through pages and I see this guy that looks exactly like me! So I looked closer and realized it was me on the advertisement for this photography company and I never signed anything agreeing to be apart of their advertisement, they never contacted me and I never gave my consent. Question is should I sue?
If someone took your picture without consent, published it without consent, profited off it without giving you a portion of the money (not sure about this one so don't book me ), and didn't even contact you to tell you what happened. I'm sure you'll have a case.
You could just contact them (phone call would be good) and tell them to remove/stop printing your picture. If they're difficult or if they won't, then get legal.
Whats the actual situation though? Are they using a professional picture of you? If so, you cant sure, but the photographer who original took it could.
Absolutely. Anyone who says no doesn't know anything about their rights. Before going ahead and suing, you should communicate with the company and request some type of payment. If they refuse, then you can begin the legal process and have the lawyers do all the work.
Although, if it's an irrelevant company that doesn't make much money, all of the money you get might just pay the legal fees only. Either way, try to handle it with them first or have them pull the ads.
