Laws on murder, burglary, assault and whatnot may have very well been based on morality, but I don't think anyone would argue that they should ever, at any point be legalized, because from a purely practical standpoint, such things would be genuinely harmful to society as a whole.
But we have to remember that morality is also the basis for laws that we see as ridiculous today. Adultery was once illegal. Alcohol consumption was one illegal (and look at how well that turned out). Homesexuality was illegal.
I can definitely understand why morality was the basis for passing laws once a upon a time, but we've arrived at the point where our mode of thinking should be a bit more complex than that. Some countries are already ahead of us on that.
