As always, they're probably more concerned about the people hosting illegal downloads than the people downloading them. This is probably a measure to catch the people that distribute pirated material, not to prosecute everyone that downloads it. They'd always come for the head first and foremost; they certainly wouldn't want to clog the legal system with thousands of fines and possible imprisonments.

Or at least that's what I'd like to think.
