Pete Wentz and Ashlee -- Custody Battle Underway
Pete Wentz does NOT want his soon-to-be-ex wife Ashlee Simpson to get primary physical custody of their 2-year-old son Bronx -- as she's requested -- and now he's taking her on in court ... TMZ has learned.
Wentz just filed legal papers in response to Ashlee's divorce petition ... asking the judge for JOINT physical and legal custody of their son. In her divorce petition, Ashlee checked the box that indicated she wanted primary physical custody.
According to the docs, filed in L.A. County Superior Court and obtained by TMZ, Wentz also wants each party to pay their own legal fees ... even though Ashlee asked the court to make Pete foot the bill for both sides.
And while Ashlee didn't specify the official break-up date in her papers -- Pete says the two called it quits on Feb. 9 ... just days after Pete came home from a wife-less trip to Dallas for the Super Bowl.

Meet Ashlee Simpson's rumored rebound boy.
Musician Craig Owens has been spotted acting rather affectionately toward the recently separated singer, tucking his arm around her shoulders and leaning over to give her a smooch on the lips while shopping in L.A.
But aside from the fact that Owens knows his way around a guitar, here are five things you need to know about the rocker, including how Pete Wentz factors into this picture...

Where You May Know Him From: The 26-year-old singer-guitarist (whose awesome real name is Craigery Michael Owens) used to front the post-hard-core group Chiodos until his mates "let him go" in 2009, writing on MySpace: "This decision was a necessary one. Out of respect for all of the hard work that we have put in together for all of these years we will not be discussing the specific reasons that this needed to happen." Owens didn't have all his eggs in one basket, though, working on solo stuff, playing in side projects like Cinematic Sunrise, Isles & Glaciers and the Sounds of Animals Fighting and guest-playing on albums from Broadway and In Fear and Faith. After the seemingly unamiable parting of the ways, Owens could be heard on Chiodos' demo "Thermacare," recorded just before Owens left but not leaked until 2010. The actual album version cut out Owens' vocals, and Owens released a new version (using his vocals and rerecorded music) with his new band...
2. He's Into D.R.U.G.S.: Awesome band name, right? Owens formed D.R.U.G.S. (Destroy Rebuild Until God Shows) with four other guys last summer. They released their self-titled debut last month and just booked the 2011 Vans Warped Tour.
3. He's Got a Good Sense of Humor: In a magazine interview, he cited his three favorite TV shows as The Office, Flight of the Conchords and Eastbound and Down.
4. He's Facing His Issues Head-On: No tiger blood denial here! In 2008, after being hospitalized for a Xanax overdose, Owens revealed to his fans via MySpace that he has struggled with manic depression, bipolar disorder and anxiety for years. (A series of 2009 entries also mention a girlfriend named Joanna.) He OD'd on July 20, 2008, at his Michigan home. "Flash ahead 12 hours later, I woke up in the emergency room surrounded by my family and best friends, with an IV in my left arm, and hooked up to machine," he wrote four days later. I felt confused, angry, selfish, and completely embarrassed. After being admitted to the hospital for a couple of days, I made my way to recovery and built up enough strength and courage with the support of my loved ones enough to make it back home. I am okay, though. Thankfully, I had no permanent physical damage to myself from this...I'm looking towards the future and have been blinded by the
brightness of it." He missed only one show and then resumed his full touring scheduled.
5. Pete Wentz Thinks He's the Greatest! The greatest artist, anyway. In January 2010, Ashlee Simpson's husband told MTV News that Craig Owens, who is signed to Wentz's Decaydance label, was his favorite new artist. Wentz tweeted to him that February, "@craigeryowens hey we will be partners in crime soon. come the middle of this month," but in June he denied rumors that Owens was joining his post-Fall Out Boy band Black Cards. He did say, however, that Owens had some "amazing new songs" in the pipeline. Sounds like the bro code was in full effect at the time.

"Right now her attention is on Bronx and some new work projects she has coming up. That's it."
So what does Wentz think of all this?

Ashlee Simpson isn’t wasting time moving on with her love life. Her divorce from Pete Wentz still isn’t finalized and the 26-year-old mom is already cozying up to another rocker, D.R.U.G.S. frontman Craig Owens, a member of Pete’s record label!
Ashlee and the musician have been spotted out and about looking very affectionate with one another, E! News reports, and on one shopping outing in L.A. the duo even shared a smooch!
Craig, also 26, was the frontman/guitarist for the group Chiodos but was dismissed from the band in 2009. He is currently a member of the D.R.U.G.S. — Destroy Rebuild Until God Shows — which he formed with four other guys last summer, and the group just booked the 2011 Vans Warped Tour, E! reports.
Craig is also signed on Pete’s Decaydance record label and is good pals with the Fall Out Boy frontman.
Pete raved about Craig to MTV News last year: “My pick for 2010 is Craig Owens, formerly of Chiodos,” he shared. “I’ve heard some of his new demos.”

Pete is taking Ashlee to court over custody of their son after she requested primary guardianship to his dismay.

Earlier today, we reported the scoop that Ashlee Simpson has moved on from her not-so-officially ended marriage and is dating Craig Owens, a friend and recording artist under Pete Wentz's record label. Sources close to Pete say that the news of his friend dating his estranged wife has left him "shocked," especially after all he's done for him.
The source close to Pete reveals:
"Pete did a lot for this guy. Craig was in another band and got kicked out. Pete found Craig, built a band around him and signed him. He's shocked at how this guy is repaying him."
For sure! They've only been separated a month. Nothing's even legal yet. It is WAY too soon for Craig to be swooping in on his woman, if even at all!
However, people in AshSim's camp say this relationship is really good for her right now and she needs Craig in her life for comfort. The source explains:

Ashlee Simpson may have found her rebound man -- who just happens to be a friend of Pete Wentz, her soon-to-be ex-husband.
Photos at E! News show Simpson, 25, shopping in L.A. with rocker Craig Owens, who holds her close with his arm around her shoulders.
(Last month, the singer-actress filed for divorce from Fall Out Boy's Wentz, 31, after nearly two years of marriage.)
According to E!, singer-songwriter Owens, 26, is the former frontman for the punk group Chiodos, and is now signed to Wentz' s record label, Decaydance. This summer, Owens will tour with a new group Wentz helped organize, D.R.U.G.S. (Destroy Rebuild Until God Shows).

'Tis the season for exposed flesh, blaring deejays and bodacious celebrity "hosts" at the ever more popular and proliferating adult pools of Vegas. Here's just a sampling of what's opening when:
*Today is the seasonal opening of WET REPUBLIC at MGM Grand Hotel & Casino. Pool management promises some sizzle March 26 when former Hugh Hefner galpal Kendra Wilkinson-Baskett hosts a party; Kim Kardashian is due April 16. Also scheduled to host, appear or deejay during the season are Sean "Diddy" Combs, Jay-Z, Rihanna, Eva Longoria, Avril Lavigne, Ashlee Simpson, Jessica Simpson, Will.i.am of the Black-Eyed Peas.
