It wasn't technically selling music. That's how mixtapes were able to be sold for so long before they got shut down. You were paying for the insert and the disc comes free with it.

I don't get how that's not technically selling music when it's literally selling music. What's the difference, other than it being sold independently with a lack of sample clearance?

This was how the entire mixtape culture operated. They would literally say "you're paying for the cardboard insert, not the cd or the music The cd comes with it for free. You're not paying for the cd, it's a free gift"
