Sure, Bey is too in a way, but she just hasn't had those 'iconic' moments. The only one that I can really think of is the Single Ladies choreo/video. So even if Bey may be more popular these days as an overall artist, her lack of memorable moments lessens her 'icon status'.
Britney's had 4 iconic/highly memorable VMA performances, a breakdown (don't discredit that. Most people you call 'icons' had a major public backlash/breakdown, and press were heavily involved in their personal life. MJ, Janet, Madge, Amy, Marilyn etc...). Her photos of her shaving her head were the highest selling shots of all time. Her music videos have almost always been memorable (with a few duds here and there), and her songs are still remembered to this day.
She represents the new generation of pop stars. She is the definition of how far the paparazzi will go these days and was the first and to be honest, still only singer to be treated this way. She's an icon, whether you like her or not.
