It varies. Some places say 8 songs is an LP, some say over 35-minutes. TFM is both of those so technically it is an LP.

I believe there's some requirement where a full LP has to have up to 10 songs, but I personally see it as Gaga's second album because it was just so big and much more different sonically than The Fame

I wouldn't say her label marketed it as her second album, she kinda did still promote some of TF although it was really close to a second album.
And I would think 8 songs would be enough for an album but since it was part of a re-release and the newer part of it, it's not its own album therefore an EP
