You have no source whatsoever saying that Apple is holding the phones at customs. Apple doesn't run the government. Do you have any sort of receipts whatsoever that they're being held at customs because Apple has filed a patent claim against the phone?

They aren't actually the ones at customs holding the phones hostage from consumers.

Their patent trolling ways presented to the ITC resulted in this temporary (inconvenient) ban.

BTW Htc phones and and all other phones including Nokias (symbian OS) have always utilized this gesture. ALOT upcoming Androids this year also face this trouble if they dont find a way to rid this supposed "APPLE idea" from there phones.
