I didn't read everyone's posts, but the max possible of 5 years comes from the other charges, not stealing the soda. Theft is regulated by state governments, and in the United States, regardless of the state, $1 theft is petit and considered a misdemeanor. In Florida, any theft under $300 is a misdemeanor.
