Thing is, the conservatorship hasn't limited Britney to doing what she doesn't want to do. The conservatorship is really only active in the business aspect of her life, meaning they handle all of her finances. We have long heard how Jamie has been let go of the reigns when it comes to Britney. Heck, he hasn't even been in California much lately. He barely sees her nowadays. He's back here in Louisiana more times than not.
Brit has been on her own making decisions for awhile now. The fact of the matter is the legal side of the conservatorship is necessary in order to keep her custodial rights as is. The only reason she got as much custodial rights back have been because of the conservatorship. Mark Kaplan, Kevin's attorney, made it known that if it wasn't for the conservatorship, Britney's interactions with her kids would be seriously limited and under watch.
As for Sam wanting Britney to go to court, he knows that girl hates everything about the court system and tries to avoid it as much as possible. The negative energy from it is just something she doesn't like to deal with because it's just another lawsuit made to take advantage of her like former exes, friends, business associates alike have done. They've sold her out to the press for a few bucks and then turnaround to sue her. Sam needs to stay FAR FAR AWAY from Britney. It's easy to compare her life from now to what it was in 2007-early 2008 when she was surrounded by all those enabling leeches.
