And you need not worry about the flack BTW will get - covers of the song have gotten more views than Ke$ha or Britney's actual videos.

All she's done with unicorns is put one on a jacket and put one on her leg, yet some of your fellow fans act like Gaga has claims over all things horned and horse-like, or that Ke$ha would see said jacket/tattoo and immediate begin hashing plans for a unicorn infested video. I agree that it is over reaching......but you can't find any irony in the fact that no pop star in the industry did anything with unicorns until recently with GaGa's jacket & tattoo....I can't recall anyone ever using them. [Lisa Frank doesn't count because she was never a pop music star].
But now that she's doing it around the same time [really though, after] as GaGa has used unicorns, it just looks tacky. It doesn't matter if it was purposeful or just for fun, she should've known to go with another idea just to be able to refute comparisons in the future. I don't find it copy cat because it's not as if GaGa created the animal, but we ALL are aware of GaGa's whole unicorn thing. I was about to point out 'the media' always compares them, but you kinda addressed that.
K$ gets called things like the poor man's Gaga, etc. all the time as they are both seen as 'crazy' or 'weird' or 'druggie' or even 'partying' (early Gaga with like Just Dance) pop stars. Also, new, since neither has been along for long. People love to compare. And with Kesha's label following the release of The Fame Monster, it just gives people (the sort to be on pop music forums) reason to compare and look for similarities.

I'm pretty sure it's safe to assume that most people aren't aware of the Gaga/unicorn association, including Ke$ha herself.

Those sort of videos are in line with Ke$ha's sense of humor and I'm inclined to think that she would be more inspired by either of those things. Unicorns have a life of their own amongst kids-who-live-online and were popular in that sense long before Gaga's usage of them.

That's fine. All I'm saying is if I worked for a pop artist like Ke$ha, as a part of her team I would think it should be a job to be well-aware of what her peers are doing in the industry to avoid any future problems like this one. In my opinion, somebody should've said "Hey, I know they're cool and all, but GaGa just used unicorns. Not saying she invented them, but we don't wanna give anyone the slightest inkling of similarity between you two."
