Right but noise from your surroundings doesn't change the measurable volume coming from your iPod. Your ear isn't meant to be exposed to that level of volume so close to the eardrum, whether or not it's in public. The volume shouldn't go above 60% anywhere - car, train, gym, airplane, etc
