Spider-man was different though, Sony owns spider man, it was never going back to Marvel, so they struck a deal to at least reap some of the merchandising benefits of Spider man.

X men go back to marvel when fox stops releasing films for them and as they are massively successful for Fox this won't happen any time soon, Fox doesn't need Marvel the way the Floundering Spider-man franchise did.

Marvel is not getting back X-Men for at least 2 decades tbh.

yeah, there's no way Marvel studios are getting their hands on Xmen, not for a good while I can see them doing Wolverine in a few years but that's about it for the core Xmen characters..
