Legally they cant do this. They already blocked one with Obama because they said the wanted to wait until the election is over. There is no way they can get away with simply not appointing a justice and you better believe Hillary will call them out every day If they don't.
I don't think there's any doubt that the Senate will confirm whoever is nominated by the next president - or at least hold a hearing - but the complete and utter obstruction of Obama's nomination is flat out wrong and unconstitutional.
