For all the people saying it's definitely Burke, think about this:
Why would John and Patsy cover up the murder by making it look like a kidnapping, write the note, and then leave the body in the basement for the police to find when they got there? They'd have plenty of time to move the body OUTSIDE the house and make it look like a proper kidnapping gone wrong. The fact that the body was left in the house made it obvious that whoever called police (PATSY) had NO IDEA the body was still in the house. If Patsy KNEW that JonBenet was dead and in the basement, she'd be sealing her own fate by calling 911.

Yes, the intruder theory is bull. It had to have been John by himself. The fact that Patsy made the phone call means she is excluded, too, since, like I said, she would NEVER have called the police, admitted to them that there was a kidnapping note, and requested them to come over all while KNOWING that JonBenet was still in the basement.
My theory, according to what I can glean from the facts, is that:
1. Burke DID NOT do it. Why? Police wouldn't have been called with JonBenet's body in basement.
2. Patsy DID NOT do it. Why? Same: Police wouldn't have been called with JonBenet's body in basement, since suspicion immediately turns to parents if ransom note is written but little girl is found still in the house she was supposed to have disappeared from.
3. John DID IT. Why? Theoretically, he killed JonBenet, wrote the note intending to make it look like a kidnapping, left the body in basement. Patsy found the note and, according to the note, was NOT supposed to call police. If she hadn't, John would tell her and Burke to get out of the house to "safety," meaning John would have plenty of time to dispose of body OUTSIDE of house, making it look like a proper kidnapping gone wrong when someone eventually happened upon the body OUTSIDE the house. Patsy royally messed up John's plan when she discovered the note and, in spite of the note's insistence, STILL CALLED the police, meaning the body was still in the house when they came over. John meant for the intruder theory to cover his tracks, but Patsy messed everything up by going to the phone and not only calling police but also calling family, friends, and everyone else over (which ended up working to John's benefit, since this provided an obfuscation of events and evidence around the crime scene). Once police were called, John had NO WAY to get JonBenet's body out of the house, so of course he had to "find" the body himself and, once suspicion fell on him and his wife, hire a legal time and throw every impossible, illogical, and absurd theory into the investigative waters to muddy everything up so he could cover his tracks.
What people don't seem to realize is, EVERY OTHER possible theory anyone could come up with makes little to no sense. Therefore, to justify their nonsense theories, they must point toward obscure evidence like suitcases, spots of blood, missing boots, and JonBenet's supposed claim that Santa Claus was visiting her two days after Christmas (two days? A very specific period of time for a child of 6 yrs old to mention. Why not just "after Christmas"?).
Everyone has their theories, though, and I'm not saying the John theory is correct, but when you think about it, it's the only theory that makes logical sense in the grand scheme of the crime itself, apart from the ridiculous theories that hinge on silly boots and irrelevant bowls of pineapple.

Criminal Minds had an episode just like this, where it turned out to be the big brother who murdered his little brother and his parents and police friend tried to cover it up.
I honestly believe it was the brother and the dad found out and tried to cover it up. I don't believe Patsy knew or did anything, she was just very unlikeable. Burke seemed jealous and had anger issues. As a child he didn't know how to handle these things. I feel like there is no real justification for the father to have killed his daughter, unless their was sexual abuse. In any case, some of his DNA would have been recovered. I believe he's covering for his son.
I haven't looked much into the case, but did they find out how long JonBenet had been dead before she was discovered?

Hmmm interesting... yeah I'm leaning more towards him than Patsy but I still think Burke did it. Not in a I wanna kill her way but something that got outta control he had hit her before in the head with a gulf club, wasn't friendly and smeared **** on the walls and JB's toys/candy. He was either a really bad kid ir he didn't like his sis at all based on that. I don't think he meant to kill her but he did... Patsy probably didn't know what to do because she wasn't part of it and her initial reaction was to call the police because they had the note anyways to blame someone else OR Jhon trynna help Burke then she found out it was Burke and Jhon was helping him?
The pineapple, the flashlight and the 911 call made me think it was Burke.. when she thought she hung up but the call was still on.. the omg what did you do/find the we are not talking to you(obvi to Burke) and the third voice.

It was definitely someone in the house!
I read a book about this that one of the detectives wrote and I never bought that intruder BS story
At first I thought of the mom but why would she do it when she invested so much time and money and was basically living through her daughter?
It wasn't the dad either and it was no one but the brother with the parents covering for them cause they didn't want to lose him too!
The brother was violent with his sister on plenty of occasions and I believe it was a accident

People saying it's stupid to call the police.. these weren't professional killers. Patsy and John had no reason to kill her but if they did they probably came up with the plan in a matter of minutes it's not perfect. Patsy called the police was part of the plan to make them look innocent.

Yeah, no. I don't see how reason #2 is supposed to apply for Patsy only, but not for John.
John was there in the room when Patsy called the police (and possibly Burke also). I'm sure if your theory was what he had planned he would have done anything to keep her from calling the cops. If you got your daughter's corpse in the basement and wanted to fake a kidnapping the last thing you wanted to happen is the police to come to your house.
Also, Patsy wrote the letter down without a doubt. John probably came up with most of the content.

It was definitely the brother it was no reason at all for her parents to want to kill her.
The brother did it in a moment of rage and the parents covered for their child!
I mean this is the same brother who smacked her in a face with a damn golf club and smeared **** all over her bed and toys... clearly this kid was a bit touched and had some inner demons

It was her brother, for sure. He is a seriously disturbed individual. I think the parents covered for him. There are literally no signs of an intruder, and the fact that the "killer" wrote a ransom note on HER notepad with HER pen, and had already killed her prior to writing the note...? No coincidence.
