Private homes aren't Pokestop/gyms. Also, you don't have to enter someone else's house or even yard to catch a Pokemon, they just need to be on your radar. I can catch a pokemon that have spawned 2 houses down in my bedroom.
Anyway, the teens were in their car when the guy fired at them and no, they didn't die.

Clearly, there are going to be careless idiots that will play this but doesn't mean that the game should be banned, if that were the case, we should just ban cars because there are thousands of people who are reckless behind the wheel.
