Except Kesha's story matches up with the story she told 10 years ago, but swore under oath weren't true because she was being sued because Luke was keeping her quiet.
The story she is telling now, was already told to her ex management back in 2005.
Amber never reported anything, so now has to reveal all evidence, and how it connects to what happened.
Kesha already connects to what was reported back in 2005, which is what makes it harder for the court to dismiss. They have to consider what was on file back in 2005, which is another reason why Luke's team haven't been quick to show evidence that nothing was previously mentioned before Kesha wanted out of her contracts.
If Kesha first mentioned this after she made it clear she wanted to leave, Luke's team would have easily won. It's problematic for the case to be settled as both sides can come up with new information etc.
