It's true, though.
Luke owns her. And he is a man, she is a woman.
She's not stating a man cannot be held by a contract either, but this contract was signed over 10 years ago. Most contracts allow you to buy yourself out if things go pear shaped, but Luke basically owns Kesha until she fulfils it.
Rape aside, this is an issue within itself. The fact that Luke can control Kesha for almost 11 years, and basically be his puppet. He can choose when she performs, who she works with, and what she does day-to-day. And until she slaves another 5 or so albums out, she cannot do what she wants.
The woman is about to turn 30, and Luke wants her to behave like a drunk teenager and sing about drinking and partying. While she DID sign a contract, Kesha may not have thought that Luke would completely control her. At the time of signing, it's worth noting Dr Luke was a rock-pop producer.
Which is where Kesha wants to go now. But Luke now has party songs at the fore-front.
Basically tl;dr, when Kesha signed this contract, she signed it on the basis of who Luke was
then. Kesha did not sign a contract to sing party songs and behave like a drunk teenager at age 30.

That alone should be enough for the judge to allow her to buy out of her contract. The rape allegations on top, shouldn't even affect the initial decision.
Luke wants to use Kesha for his interests, and not hers. A contract should not force a person to do something they don't want to do. Luke literally did not care for Kesha's well being, he only cared about how much money he was making from her.
This was clear when he didn't give a CENT to her for Right Round.
It would be like if Interscope forced Gaga to record a million Just Dance's. Or if Beyonce was forced to stay with Destiny's Child for another 6 albums.
