Actually, you can

the US did it (just an example).
Lawsuits are how your country got civil partnership and full adoption rights in the first place. There just hasn't been a marriage case in the past few years. Usually, marriage comes first then adoption (sometimes at the same time), but Austria did it backwards.
The only thing standing in the way is just one lower court moving the case ahead so the Government can appeal and send it all the way up to the Constitutional Court who should side with couples
