North Carolina Cops Aren’t Sure How To Enforce Anti-Trans Bathroom Bill

Now that North Carolina’s horribly transphobic “bathroom law” is on the books there’s just one major problem: Police aren’t quite sure how to enforce it.

Governor Pat McCrory signed the new bill into law last month, mandating that people use restrooms which match the sex they were assigned at birth rather than one that matches their gender.

Perhaps one of the most problematic parts of the law, which has been skewered on a national scale as “wrong beyond repair” and one of “the worst” in the country, is that it’s still up for interpretation by the police officers who’ll no doubt be called upon to enforce it.

An investigation by Mother Jones shows the extent of confusion among different police departments across North Carolina, which for the most part said they’d just have to “use their best judgement when responding to complaints” because arresting someone for using the “wrong” restroom may actually still be against federal law.

“That’s a very interesting question. We don’t have police officers sitting at public bathrooms all day long,” a spokesman at the Raleigh Police Department told me with a laugh.

Over in Greensboro, the state’s third-most-populous city, I received a similar answer. “We would respond if we received a complaint. It’s not like we would be standing guard at bathrooms,” said Susan Danielsen, a spokeswoman for the local police department, also suppressing a laugh.

At the Wilmington Police Department, spokeswoman Linda Rawley said the law struck her as strange. “So that means people have to go to the bathroom with birth certificates? Yeah, that was curious to me.”

At the Asheville Police Department, spokeswoman Christina Hallingse noted, “We’re not checking birth certificates. We just don’t have the police power to be able to do that in bathrooms.”

“These are all completely open questions,” Cathryn Oakley, a senior legislative counsel for the Human Rights Campaign, said when asked if police could patrol public restrooms and/or demand identification from people entering them.

I've participated in several of the NAACP's Moral Mondays protests that have been ongoing here since 2013 with focus on various issues. If they do a sit in for this, I will definitely participate as well. This is deeply shameful and I'm really disgusted that this has happened here.

Big Business keeps pulling out of the state and the Governor is now in danger. It's gotten so bad that the political label on NC has moved from leans GOP to toss up in November.

Why would they even pass such a dumb law? It would have made more sense to require more unisex bathrooms. My residence hall had a bathroom with multiple stalls and urinals; you just had to change the sign on the door to not surprise anyone, or you could go to the single unisex bathroom down the hall.

Also, it's funny how the police are denying upholding such a complicated law.

I don't get the gender neutral bathroom thing. Why don't we just let men and women (including transgender people) use their respective bathrooms? I see no issue with a trans-woman using the ladies' room, or a trans-man using the men's room.

Whether or not you agree with the legitimacy of transgenderism, this is a really unnecessary law. It's supposed to prevent men from attacking or sexually assaulting women in bathrooms. But that's not really a common thing anyway, and even if it were to happen, that's already covered by laws for assault/battery, sexual assault/harassment, and hate crimes.

This is why trying to put laws like this into effect don't make any sense. Believe it or not, it's not always automatically obvious if someone is trans. And there are some people that are cisgender, but look more masculine or feminine, and can you imagine if someone called them out for being trans and they had to explain that they weren't? it would be a mess. if you're so worried about people attacking other people in bathrooms, then reprimand those people when it actually happens. trying to prevent all trans people from using the bathroom isn't going to solve the issue of bathroom assault, which honestly doesn't seem like all that big of an issue

Yeah, this law is silly. I can't imagine how they'll enforce this against every violation without requiring a court order to see the birth certificate. And I can't see any court actually granting that for an arrest.

On top of not having the man power, how are they even gonna arrest ppl, they can't check a person's genitals to see if a law is being broken.

Am I the only person in the world who doesn't look at other people in the bathroom? I swear a naked 80 year old woman could walk into the men's bathroom and I wouldn't even notice her.
