That picture couldn't have been used as evidence. They were working together in the past and we all know long hours in a studio can lead to artist falling asleep in a couch or somewhere else. I am not defending Luke in no way though, his legal team probably advised him to remove the picture considering everything he and Kesha are going through right now.

As a Scream Queens fanatic and a Niecy Nash enthusiast, this definitely looks suspicious on Dr Luke's part.
