Butch and Avril came up with a song that you could call "Girlfriend Beta", rightfully and legally based on the song "Hey Mickey". Luke "stole" the idea, convinced Avril that he could do it better than Butch and Girlfriend as we know it today was born.
So Luke stole the groundwork for the song. That's why the original songwriter tried suing. Butch got clearing for the sample while Luke didn't. And Butch punched him.
