Yep. HIV tests usually look for HIV antibodies, which usually take about two to eight weeks from the time of contraction to form. In rare cases, they can take as long as six months.
While I do think some sort of ban should exist in some form, even if people can just lie or whatever, if Canada's policy is anything like the United States', it definitely does need to be changed. In the US, no man who's had any sexual contact with another man once since 1977 can donate blood.
