Many labels will be after her. Universal and Capitol have both shown interest. If worst comes to worst, she can be an independent artist. Being able to release music > not being able to, but being signed to a major label.

It would depend on the contract, I guess. Kesha's is an eight album contract with Kemosabe Records. She's only released two albums.
