Encouraging someone to do heinous crimes is a crime in itself. You really need to read up a little on the unequivocal essence of Mens Rea. Whilst those who encouraged this obviously deranged man might have not thought he was being serious, they also as conscious and law-abiding human beings knew that there was a possibility that this man was being serious. Therefore, those 4chan users are culpable for their reckless state of mind when they replied to this man. With that, they had a somewhat guilty mind in knowing the risk they were taking in replying in such a way to this man.
You can't hide being 'free speech' for everything. You can't tell someone to murder another person and then say, 'I was merely expressing free speech'. No, that's a clinically insane insinuation and one which concerns me.
Trust me, if the family does want to press charges against these 4chan users, they will have a case. They should be held responsible for being so reckless and heartless, telling an obviously deranged and depressed man to 'do it' and encouraging him to commit the crime; whether these users really believed he would commit the crime is irrelevant.
