An Oregon judge is being investigated for refusing to marry gay couples because of his ‘deeply-held religious beliefs.’
Marion County Judge Vance Day is under investigation by the Oregon Commission on Judicial Fitness and Disability after he stopped performing marriages after a federal judge struck down the state’s gay marriage ban last year.
The case came to light on Thursday (3 September) when the judge’s request to create a legal defense fund was approved.
‘It is not my job to perform weddings,’ Day, who is also the former chairman of the Oregon Republican Party, told KATU-TV.
‘I have the option of doing that and I’ve chosen not to.’
He added: ‘I have nothing against my gay and lesbian brothers and sisters.’
Judges in Oregon are not required to perform marriages – but Day did officiate the weddings of four straight couples between May and September 2014. He then stopped performing all marriages with the exception of another straight couple in March.
‘It’s an exercise of his religious freedom rights under the First Amendment,’ his spokesperson told KGW-TV.
