However, you can see a professional artist created these .gifs.

In my opinion, that artist should be profiting from each time we use this .gif. Imagine if your content was being used by a lot of people in expressive ways, but you don't profit from it. Additionally, this artist is likely unaware that we are even using his/her content en masse.

Another thing to think about... is ATRL somehow profiting from our usage of this .gif? Is that grounds for a lawsuit?

Hm, normally I would say gifs qualify as fair use and that they're transformative works (when they're made from copyrighted material.)

But this is a very specific case. I'd still refer back to what I just said though, we freely use gifs other people create without credit to their creator (of the gifs) and those are all unique works even if not made from unique content (or a professional artist.) Until that becomes an issue, I can't see this being one. It is in the nature of the media, gif, for the content to be spread. Anyone who is using those baboon gifs is simply using gifs as gifs. We aren't using those clips in marketing material, a professional presentation, or combining them with other clips and packaging them in a video that we are selling. Since gifs are a type of meme, I can compare them to that and mention that you personally can use the troll face meme anywhere you want, post it, remix it, etc. until you try to include it in something you're selling or claim it as your own - then you're violating the copyright and will get a notice from the creator.
