In South Asia, hijras aren't considered female or male. From ancient times in Hindu culture, they've been considered a third gender (and you'll see them walking around everywhere in Nepal, India and even Pakistan). It's not the same as the concept of transgenderism that's in the west.
Also, most people there think hijras are hermaphrodites (intersex). They're usually transgender people or even poor gay men who think it's better to be a hijra than an openly gay man (the former is much more accepted than gay people).
This is one of three things Nepal's Supreme Court ordered Parliament to do. The other was gay marriage and anti-discrimination laws, but the Constitution writing process has been stalled since the Court verdict in 2007.
The draft Constitution released cites LGBT as a protected class and marriage is at the committee stage so if all goes well then the two remaining orders will be fulfilled when a new constitution is promulgated by the end of the year.
Not getting any hopes up but hopefully that really is the case.
