I think with those anti-discrimination laws being banned it just means that you can't sue your boss/be protected if they do fire you. That's what I saying, I know for a fact it happens and I can give you an example. Ford back in 2009 was looking to cut a lot of people, a lot of old employees to be honest that were going to be retiring in a few years.
Normally they would offer a buyout say if you had 28 years they would give you the 28+2 and you walk with full benefits but not this time. Back in around 2008 they offered the 28+2 package and a lot of people took it but a lot of people didn't thinking they would never be let go with 1 year left to be 100% vested in their pension.
They hired a outside company to do the firing. They went over the employees and made sure they axed enough people, like new employees, middle of the pack employees and then the people with 28-29 years were hammered. One of my old managers was one of them she now works part time for me. She kind of got double screwed because when Ford bought 33% of Mazda she was moved over to Ford and they didn't give her the 3 years of Mazda and started her out at 0 at Ford. She would have been at 30+ if they had applied the 3 years at Mazda.
Then Ford started to hire back the middle tier people as special contractors to retain their knowledge and some of the old people as well agreed to come back but 2009 was a bloodbath for Ford employees and contractors. Ford slashed hourly rates for contractors forcing Compuware to pull every one out, which collapsed Compuware's consulting arm, several other business folded or sold/merged to stay alive. Compuware just fired everyone in IT consulting if they didn't find a position in HQ.
So in short these laws are useless.
