So? Eau De Gaga and "Cheek To Cheek" are her works and therefore she can use both as she pleases. 'TIHTY' was written for the movie, which means the company that owns the movie also owns the song since they most likely funded it. That would be like Idina Menzel taking 'Let It Go' and using it to promote another movie that isn't Frozen. It wouldn't be allowed.
