When simply looking at this guideline of the statute, what Madonna did was take your copyrighted material and use it in a nonprofit manner - the equivalent of a blog post - whereas on your website you take copyrighted material and sell it for profit - a commercial use.
I know this view may vary depending on your political views, but I believe the law should treat people the same regardless of how much money they have. Going after Madonna simply because she has a lot of money is ridiculous when you're blatantly guilty of the same crime you're accusing her of but to a further degree.
