The only reason he wasn't decapitated was because of luck/his own actions. The elevator company, or where he works (probably both, tbh), were negligent and nearly caused another person to die. Which also means that other people were at risk of suffering the same fate. In that kind of situation, you CAN sue because their negligence puts people's lives at risk, even if no one died due to luck and/or intelligence on the individual's part

Reasons like this why I hate elevators and will always choose to take the stairs.

I have minor fears of elevators. When I go to the dentist, I always take the stairs, otherwise I'm practically forced to go in one when around family. Now this convinces to take the stairs more often.

He was nearly halved, not decapitated.

And yes, I would sue...if I were in a better country.
