The Government is elected by the people and we can change the state laws with ballot initiatives. California put ballot Proposition 34, which would eliminate the death penalty, up for vote in 2012 and the most liberal state in union shot it down. The people not the government.
It took a Bush appointed judge in 2014 to come to the conclusion that the state of the system California was running was unconstitutional. In a nutshell if you tell someone you are going to execute them, you have to do it; otherwise it amounts to cruel and unusual punishment.
So we will see how this case progresses though the 9th circuit up to the Supreme Court.
Anyway the citizens gave the right to the government.
