Man fired for having cancer
Quote:
A 19-year-old delivery driver diagnosed with cancer claims he was fired from his job at a suburban Chicago restaurant when he informed his employer he needed to take six weeks off work for surgery.
Jonathan Larson was diagnosed with cancer of the brain and spine. He has had several rounds of radiation and now needs back surgery, he said.
The surgery would require him to take time off of his job as a delivery driver at Naperville’s Rosebud Restaurant. Larson claims that when he told his boss about his upcoming procedure and said he could be back in six weeks, he was let go.
“[My manager] said, ‘No, by that time I’ll already have another driver hired. Just leave, I have to make some phone calls,” Larsen said. “I’m really disappointed and saddened by it. It’s not something I can help.” (read the full article)

It's legal, in the US people can get fired for mainly anything other than race, religion etc.
It's probably a min. wage job, they're not going to wait 6 weeks for you to come back and they're not going to fire his replacement who's actually doing the job. It's tough, but that's life. If he sues, he'll probably not win.

Sounds reasonable to me. 6 weeks is a long time and they'd have to find someone willing to deliver only temporarily

That's sickening if that's legal in the States...
Completely illegal in Canada

It's not reasonable at all. Stuff like this is illegal in other countries and they seem to manage.

I get it if they are firing him temp... such as hiring a new driver in his time, but they should be open arms to letting him back.

It would be different if he was employed in an office job or something.
But a Min Wage job isn't secured for yours to keep. People give you work for as long as they can afford it.
If the owner can only afford one driver, he can't hire another one for six weeks and then keep both. He'd have to fire the new driver, which would put that person in the same place as this person.
The owner could have said it better though. But that's reality.
---
Also, the treatment takes six weeks but you should NOT jump back into work straight away after Cancer. Your body needs to be strong post treatment, or it can come back. Weakening your body when it needs rest only lowers your ability to beat it.
No matter what stage, you need rest before and after treatment.

Yeah thIs. They didn't fire him because he has cancer, that title is misleading. They let him go because 6 weeks is a long ass time, especially during the holiday season. If he needed 6 weeks off for any other reason he still would've been let go

Pregnant women can have 6 weeks after the baby is born...i don't see why sick ppl can't get the same treatment
especially when Cancer is something you have no control over

I get that, but it's still mindblowing to me that someone can be let go from their job because of a serious illness they can't control. Like I don't know about the law on stuff like this in the US but here in the UK it would be unlawful dismissal to fire someone in this situation without first at least attempting to accommodate the needs of the employee first because employers have a legal obligation to support their staff as best they can.

Damn, American members believing this is acceptable, your culture is really bad in that sense. This is not right or ethical in the slightest, regardless of if it is a minimum wage job or not. If this happened in the majority of any other westernised country there would be uproar, as its illegal in most places.
This guy should be given the time off, the company should advertise for a new driver on a temporary basis, why is that so difficult? Then when the guy comes back the new driver will be let go, as he would have only been hired on a temporary basis..

If it's a minimum wage job with no benefits, especially as a delivery driver, then yeah. He should have seen it coming. It sucks.

"He should have seen it coming."
What? This is so insensitive. Like anyone can control the diseases they get. I really hope that you don't fall in the same situation.
