He shot and killed her in the alley? I mean she wasn't in the house any longer? There comes a point when he is no longer in danger that he should have stopped.
Legally he should be prosecuted

For him to hunt her down and kill her is too much, you're only allowed to defend yourself when you're in danger and he wasn't any longer.
