I think he will be convicted of premeditated murder instead of manslaughter. He was holding a gun prior to the break in. If he ran upstairs to grab his gain after realizing that someone had broke in, then that would be premeditated.

If they'll able to break on the front door, go inside your room and lock your room. The police will be there soon enough before they get to your room. Push your drawer or bed or furniture against the door.

Did you guys read the article? I'm all for defending our homes but the man definitively got carried away. He shot the guy 3 ****ing times, even after he knew he was unarmed and likely already dead. Then, minutes later he shoots the girl. he wasn't just defending his home, he has some sort of sick blood lust and wanted to kill. Shame on the teenagers for entering though.

It was not a fare fight. He had a gun, the other two unarmed.

The case being used is fishy. The dude waited a day before calling the police about the break-in, but I don't see what that has to do with random, law abiding citizens shooting burglars in defense of themselves and their property. Getting shot and killed are risks you take when breaking into people's homes.

Nobody deserves to die, but they were kind of asking for it. I wouldn't have shot them at first, but threatened them with a gun

Well actually he should be going to prison for this, but not for shooting them or even for killing them... but for making sure they were dead.

You don't continue shooting people once the threat is subdued, that turns it from self-defence to murder. If there's no belief of imminent threat you should not be shooting.

You can't walk over and do a "control shot" to the head, that's not self-defence, that is execution.

No. The thread title asks a very specific question that is different than the question asked in the OP.

So you are getting people answering one or the other. Most are answering the one in the thread title.

I would have done the same. Warned them that you have a gone or approached them and scare them by pointing the gun at them.
