As long as you have the server files for the game, you can host your own private server.  And if the developer puts legal obstacles in your way, you should not buy their games in the first place.

The point was, a lot of games only have an active server for less than 10 years. You can of course have private servers, but it's not the same as using the server on the bigger scale.
But consoles like the PS3, 360 etc. will be able to run private servers with hacks etc. So it's the same as PC, they just end official support, just like companies end official support with PC games.
But in reality, who really plays the game after official support stops anyway? There is usually something better to replace it anyway. But I've had a lot of games (that have been free after purchase) that have had support end on PC
The only sad part for Wii owners, is that Nintendo are only doing it so people buy the Wii U.
If Sony still allow people to use the PS2 online, than Nintendo should allow it until people have pretty much stopped playing the games anyway.
