The 1st Class Civil Appeals ordered the tour promoter Time For Fun to indemnify a consumer for the delay of almost four hours at a Madonna concert in Porto Alegre (Brazil). The presentation took place in December 2012.

Case

The plaintiff filed suit seeking compensation for moral damages. She claimed that the show was scheduled for 7:30 PM, but only began at 11:00 PM. The action was dismissed by the 5th Special Civil Court of the District of Porto Alegre, which accepted the request of the consumer.

Decision

The Judge Pedro Luiz Pozza, rapporteur of the case in the 1st Class Civil Appeals, upheld the conviction, fixing a compensation worth R$ 1500 (640 USD).
The judge understood the delay as abusive, especially when the show is on a Sunday, well known that Monday is working day, when people need to wake up early for work.
