If he was getting sued, I would bet that it has something to do with Nintendo rather than Piou Piou. The only thing that Piou Piou and Flappy Bird have in common is that they both use a bird to go through the obstacle, while their main game mechanics is borrowed from

can't be copyrighted. Otherwise both games are different enough that they can co-exist in the app market.
Supposed clone games aren't new, the gaming industry (not just pertaining to the app market) is littered with them.
