You also have freedom of speech but the school can still penalize you for it. Also the video was public. Just because it happened outside of school, doesn't make it "private".

So it's available for public viewing online. Fine. He's still of legal age.
Whether filming **** legally fits under whatever morals clause they have is debatable.
The cops can't get involved because there was no law broken so it just comes down to a public school clearly trying to save their "brand" for something in poor taste this kid did.
They are not a private institution so it won't hold up in court, if he does decide to sue.
