Can a public school even punish you if you do something ILLEGAL outside of school property/events? I thought that would be the responsibility of law enforcement. Since when did schools become the police? Either way, it is legal to do **** if you are old enough (which he is), so I don't see why his school would be punishing him. And on top of that, HE was the one getting bullied for it.

Its not one or the other, you'd be punished by both. Law enforcement would inform your school.

The cops would punish you obviously. The school then has the choice to suspend you. They are not forced to.

You're kinda missing the point tho. They don't have to break a law. Students sign a similar agreement as teachers which states they will represent the school appropriately on and off campus. Not that they will follow the law.
The courts will then analyse the contract, and the case determined based on if making a **** is deemed as inappropriate(or whatever word was used) or not.
If they can suspend a teacher for violating the same agreement, I don't see why they can't for a student.
