I thought that was a pretty obvious homage though. I guess they didn't credit them. They do have definite melodic similarities.

No offense but there are loads of rock/alternative who use the same guitar riffs, same patterns etc. from eachother and we don't hear much about seing in that case, while if a pop act does it, it is stealing and it has to be sued, it is just all about getting a quick cash
