Attorneys for the singer, who released her ARTPOP album cover Monday, wrote:

“It has come to our client’s attention that you have filed an application to register the mark GAGAJEANS and are using the GAGAJEANS mark in connection with the jeans."

"In particular, you have misappropriated the dominant feature of our client’s mark, GAGA, and merely added the generic term 'jeans.'

"Your use and registration of the GAGAJEANS mark is likely to cause confusion, mistake, and deception of consumers that Lady Gaga is affiliated with [the product]."

According to Gaga’s attorneys, Smith also commented on Lady Gaga videos attempting to direct fans to his website, gagajeans.co (which has since been taken down).

As such, they demand that Scott abandon his trademark request, deactivate his website, cease and desist making the jeans, destroy any prototypes and more.

“If we do not hear from you by October 10,” the attorneys write, “we will assume that you have no desire to resolve this amicably and we will proceed accordingly without any further notice to you.”

Honestly I think they need to lighten up. The word Gaga has been associated with crazy way longer than she was around. Just my 2 cents. As long as her likeness isn't used in them I don't see what the issue is.

I've never seen that but then if that was happening they should sue because it connects her to the brand when she doesn't have anything to do with it. I haven't read the full story. Is that what they're doing?

I can see both sides of this.

The word "gaga" has been used as a synonym for "crazy" for YEARS AND YEARS before Lady Gaga started making it in her name. In addition, Lady Gaga herself stole the word from a Queen song. The creator of the jeans could simply be meaning they're "crazy jeans".

However, the fact that they're advertising on Gaga videos makes it very obvious that they're trying to capitalize on Lady Gaga's audience and connect their brand with hers. If they hadn't done that, they might've gotten away with it.

But when you have a major brand such as Lady Gaga, which doesn't even really need "Lady" in front of it to be recognizable, you can't have something such as "GAGAJEANS" out there making money. Wouldn't you think GAGAJEANS are associated with Gaga if you had never read this article nor heard of GAGAJEANS?
