Yes you can still make decisions when you're drunk, but not good decisions. Even if you are buzzed that still counts as being intoxicated, and would still be considered rape

He's not asking if it's okay to take advantage of a drunk girl, he's asking if a drunk entity, submissive in sex, is able to give consent. If people were reading instead of jumping to conclusions, this wouldn't be a huge deal.

In my opinion, regretting a one night stand and going 'oh, shoot' in the morning can not be considered rape. Especially if held into comparison with others who are very conscious while being raped against their own will, and who are downright being molested and traumatized.

No. Drinking does not change who we are, it just alters it. If I don't want to have sex before I'm drunk, I won't want to have sex while I'm drunk. And if I decide to then that's my own fault. It would only be rape if the person was unconscious or if the person was telling the other person to stop but they continued anyways.

I get what he's asking. The commercials for his shows always involve some open ended question. Like, "Is it ok to beat your kids" or "is it ok to let your spouse cheat." So, knowing that he does that, I get it, but that tweet doesn't provide any context. Perhaps, if you watch the show or are familiar with Dr. Phil, but twitter is not the most serious of mediums to be asking such a question, you know? That coupled with the way he phrased the question and the fact that the question is beside his cheesy grin. It looks messy and comes across like he's making light of the situation. I mean, "Reply yes or no." Why is he polling such a thing on twitter? If someone created a thread asking the same question here, it would get closed quickly.

I find all this talk of 'overreaction' to potential misogyny coming from GUYS to be slightly problematic. You are not a woman. Your opinion on what is or what isn't sexist is irrelevant.

Now that that's out of the way: you need a person's consent to have sex with them. Don't take advantage of a drunk person too incapacitated to consent or dissent - obviously.
