But from what I understand, Thicke's suit is also about whether or not the Gaye family has the right to sue because EMI owns the publishing rights to Got To Give it Up, even though the Gaye estate still gets royalty checks. A good question would be, if the Gaye estate can't sue, can EMI? If I'm not mistaken EMI and Interscope have the same parent company.
No one can tell me that BL isn't a rip-off GTGIU. The biting is so egregious that lots of people (including myself) just assumed that Marvin's song was legally sampled, because such brazen copying, of such an iconic song, is begging for a law suit. Usually when artists rip-off something, it's obscure, which GTGIU certainly is not. GTGIU and What's Going On are like, Marvin Gaye's two most famous songs. I mean, if you're gonna do it, at least rip off Marvin's lesser known material.
