So Zimmerman is charged with second-degree murder - unplanned/not premeditated murder. Okay.
So what does the prosecution have to prove exactly? We know that Zimmerman shot Trayvon. The evidence shows that Zimmerman instigated the entire incident. We realize the HIGH likeliness that racism was his motivation for pursuing Trayvon. What else does the prosecution need to say?
I know I personally feel that Zimmerman should be convicted. I'm just trying to decide how I think
the jury will rule. The most unclear thing about the whole incident is Trayvon being on top of Zimmerman according to witness accounts. I see how the defense might use that, but his being on top of Zimmerman does not necessarily mean that Trayvon attacked him or that he was even winning the fight. In fact, the phone call with Trayvon's friend as well as the fact that Zimmerman went out of his way to pursue Trayvon is telling me that Zimmerman was the attacker. But it's not totally clear and I do fear that the jurors may interpret these witness testimonies the exact way we
don't want them to.
I am going to guess that Zimmerman (ever so racistly) pursued Trayvon and started a fight with him. Then Trayvon fought back, and then Zimmerman shot him. I'm not sure what that means to whether he can be convicted.
I believe that this is the truth and that the fault rests on Zimmerman, but this is no slam dunk. It may be difficult for the prosecution to prove this beyond a reasonable doubt and I see a bunch of ways the defense can twist the story just because everything is so unclear.
This won't end well. I have a bad feeling that Zimmerman will walk free, but I can't say I will be surprised.
