This was done in the early 2000s so it should have been cleared. It doesn't matter if "no one" knew, it still should have been cleared.
Granted, he may have not known the song would have picked up steam like this, therefore they could have been in the process of clearing it. Who knows!

It is true. I've taken Media classes in college that covered on Copyright.
Why do you think Girl Talk gets away with all his samples? They fall under "fair use" and none of his samples date back 100 years.
In Azealia's case of Harlem Shake BECAUSE it's an instrumental track in it's original form, her rapping over the track could confuse listeners into thinking it's HER song.
NO ONE is confused into thinking the original sample and Harlem Shake are the same song.
