Texas Dad Kills Drunk Driver who killed his kids
Quote:

Texas father, who watched a drunk driver strike and kill his two young sons, has been charged with murder after allegedly shooting the driver in the head moments after the accident.
David Barajas, 31, was charged with murder on Monday, more than two months after his sons David Jr., 12, and Caleb, 11, were killed steps from their home on a rural road outside Houston.
Bond was set at $450,000, police said.
Barajas and his sons were pushing the family's disabled pickup truck toward their home late that night, as the boys' mother and two younger siblings sat inside.
They were struck by Jose Banda, 20, the driver of a Chevy Malibu, instantly killing David Jr. and critically injuring Caleb, who later died at a hospital.
"Banda was determined to be intoxicated at the time of the crash," police said in their report.

Hmm, I don't know what to think about this to be honest. Read some where people look at him as a "hero", and any other man would have done the same.

Good that he was charged with murder. That's not heroic at all.
Guns + people who think the law is in their own hands = bad combination.

He will be let go, I remember seeing a video of a guy who killed the guy who either raped ir killed his son and he was let go becuase it was a crime of passion. Also this is Texas, he will be given a medal.

Really sad. I don't think he should have taken the law into his own hands though.

What good does it do to enact revenge? It doesn't bring your children back there's no point to it.

I can kinda see why he would kill the drunk man tbh
I don't think he should have, but I think it's kinda justified

That's not tough to decide:
What he did is very understandable. Yet, it is against the law.
He should be punished in some way, obviously. But the circumstances should be taken into account.

It's definitely understandable but damn, he shouldn't have done it.

I am surprised at the replies tbh. On ATRL we are used to more drastic and - uhm - emotional responses to news like this.

I understand why he did it, even though it was not the right thing to do but that man killed the other man kids and not one but his two kids,

He should be in jail. You don't take the laws of justice into your own hands. And you especially shouldn't think killing someone is justified and that you shouldn't be charged AT ALL. What's the point of having jails if they aren't used by people who break the law?

There's no way a Jury would convict him of a serious charge! He did society a favor when he killed that drunk driver

you know what, if two of my sons were killed before my eyes by some drunk idiot who decided to drive - and for some reason i had a gun - i would shoot him, too. i dont think this guy deserves jail. it's not like he's a danger to society, he just reacted to the horrible incident, and thats completely understandable. im not saying his murder is justified, but in these circumstances, i don't know what else he could have done

It said he shot him "moments" after the incident.
For all he knows, it could have been on purpose and the drunk driver was coming out to kill him too.
It was self-defense in my eyes.

What if it was a teenager who lost control of the car? Or an elderly person who's foot got stuck on the pedal? But since it was a 20 year old kid who was drinking and driving it was justified and he should get off? Please. He ended a child's life as well. He shouldn't get off.
