One digital track is permitted as instant gratification for an album pre order. A retailer offering this pre order incentive must report the instant gratification track to OCC as a promotional download.
While this rule is being applied to the pre-order downloads of the track ALL sales of the digital track, even those outside of the pre-release promotion, are ineligible.
The alternative would be to count the sale of the pre-release promotion track as a single then disqualify sales of the album when it is released since the album will not have been downloaded in its entirety to satisfy other album chart rules. Under the rules in force the OCC are effectively allowing one album track to be downloaded in advance of the release of the album.
