These companies set up licensing agreements that allows the usage of certain technologies. Since carriers are Samsung's only outlet to sell their phones, it's possible a licensing agreement was set up to allow them to use LTE in exchange for promoting Samsung's devices, or a cut of revenue, etc.
And good for Samsung

Someone needs to knock Apple down a peg. I don't know how likely they are to win with this though.
